PLEASE NOTE: that in order in be eligible for appeal, you must have petitioned for reclassification of your Residency status for the school term in question. If you have not petitioned it is suggested that you refer to the Student Survey to determine your status with regard to ABOR residency requirements. You may obtain the appropriate petition form at Residency Documents. (Please be aware of the ABOR established deadline dates for submitting residency petitions)
It is recommended that the petitioner consult with a representative of the Residency Classification Office prior to requesting an appeal hearing.
ABOR Policy Number 4-207 indicates that the request to appeal the decision of the Residency Classification Office must be submitted no later than 35 days after the last day of registration for the term for which the initial petition was submitted. Failure to properly file the appeal request prior to the established deadline date constitutes a waiver of right to appeal. In addition, in order for the appeal to be heard by the Appeals Board, the appellant (student) must submit a Residency Appeal Form covering all items listed above including the FERPA ("Family Educational Rights and Privacy Act") Waiver statement in order to comply with the Arizona Open Meetings Law.
Upon the receipt of a request to appeal that is submitted in accordance with ABOR Policy Section 4-207 of the Guidelines, the appellant will be scheduled for the first available date and time for a hearing before the Appeals Board. Appellants are scheduled for hearings based upon the order that the Residency Appeal Form is received in the Residency Classification Office.
Failure to properly file the appeal within the prescribed deadline dates constitutes a waiver of the appeal privilege for the current enrollment period.
Please keep in mind that the next available hearing date may be 4 weeks from the date of your appeal request submission. Once an appeal has been scheduled, cancellations must be submitted to the Residency Classification Office in writing at least five business days in advance of the scheduled appeal date.
The appellant (student) may be represented at the hearing by an advisor at the student's expense. The Appeals Board suggests that appellants who have petitioned as financially independent students also submit 12 months of complete bank statements if they have not previously done so.
Appellants will be notified by letter of the Appeals Board decision. Appellants who are reclassified as resident students will be refunded the out-of-state portion of the tuition that has been paid for the term in question. In accordance with the Arizona Board of Regents policies the decision made by the Residency Classification Appeal Board is final.To reach their decision, the Appeals Committee will review all aspects of your application, not just the points of your petition denial.
