Frequently Asked Questions - Visas/Non-citizens
- I am not a U.S. citizen; can I qualify for residency?
- Residency eligibility for non-citizens is determined by the visa category in addition to the regular requirements. Non U.S. citizens who have student visas or another visa that is temporary (i.e. F1, J1, H class visas)are not able to establish permanent domicile in Arizona, so they are classified as nonresidents for tuition purposes. Non-citizens who have been granted legal immigrant status or permanent resident status through the INS are classified for purposes of residency status according to the same criteria applicable to U.S. citizens.

- I had an F1 visa but I have married a U.S. citizen; can I now qualify as an in-state student?
- Not necessarily, holders of visas that are temporary (i.e. F1, J1, H class visas) that become permanent residents or U.S. citizens are eligible for residency according to the same criteria applicable to U.S. citizens. You will need to meet all three of the independent requirements: one year showing presence and intent, and two years financial independence, unless you meet one of the exceptions. Please discuss your situation with the residency classification office.
